The Service is intended for users aged 13 and older, consistent with the age threshold stated in Privacy Policy §8. In jurisdictions where the General Data Protection Regulation (EU/UK GDPR) or an equivalent regime sets a higher digital-consent age — up to 16 under GDPR Article 8, or such lower age (between 13 and 16) as the user's member-state has legislated — you must meet the higher threshold applicable to you, or have verified parental consent recorded under the mechanism described in Privacy Policy §8 and its Appendix C-1.

This app is provided "AS IS" without warranties of any kind. To the maximum extent permitted by law, MiraSeed's total liability shall not exceed the greater of (a) twelve (12) times the monthly subscription fee paid in the twelve (12) months preceding the claim, or (b) USD 100.

The following clauses apply to you if you obtained the iOS version of the Service (the "Licensed Application") through the Apple App Store, and prevail over any inconsistent provision elsewhere in these Terms as between you, MiraSeed, and Apple.
You acknowledge that this EULA is concluded between you and MiraSeed only, and not with Apple Inc. ("Apple"). MiraSeed, not Apple, is solely responsible for the Licensed Application and its content. To the extent that these Terms provide for usage rules for the Licensed Application that are less restrictive than the Apple Media Services Terms and Conditions, the more restrictive of the two applies.
The licence granted to you in these Terms for the Licensed Application is a non-transferable licence to use the Licensed Application on any Apple-branded product that you own or control, as permitted by the "Usage Rules" set forth in the Apple Media Services Terms and Conditions.
Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. MiraSeed, not Apple, is solely responsible for providing any maintenance and support services, as required under applicable law or as set out in these Terms.
MiraSeed is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be MiraSeed's sole responsibility.
MiraSeed, not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product-liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation. Apple is not responsible for any third-party intellectual-property claims relating to the Licensed Application.
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual-property rights, MiraSeed, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless-data service agreement).
You and MiraSeed acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.
